These SMS Message and Alerts Terms (“SMS Terms”) apply to your use of Cpapcore SMS messaging and alert services (“Service”).
By using the Service, you agree to these SMS Terms and the applicable Privacy Notice.
1. The Service
The Service provides SMS messages related to product usage, reminders, and service-related information.
Messages may be sent using automated technology. Consent to receive SMS messages is not a condition of purchase.
You may opt in by following instructions provided at enrollment.
2. Eligibility and Consent
You represent that you are at least 13 years old and the authorized user of the mobile number provided.
If you are a business customer distributing the Service to end users, you are responsible for obtaining all legally required consents, including under applicable laws such as the Telephone Consumer Protection Act (TCPA).
3. Message Delivery and Limitations
Message delivery depends on your mobile carrier and network availability.
Cpapcore does not guarantee that messages will be delivered, received, or timely.
4. Message Frequency and Charges
Message frequency may vary, up to approximately 25 messages per month.
Standard message and data rates may apply depending on your carrier.
You are responsible for any charges imposed by your mobile provider.
5. How to Opt Out
You may opt out at any time by texting:
STOP
to the designated service number provided during enrollment.
You may receive a final confirmation message after opting out.
For help, text HELP or contact customer support.
6. Use of Service
The Service is intended for personal, non-commercial use unless otherwise agreed in writing.
You are responsible for maintaining accurate contact information.
7. Important Medical Disclaimer
The Service is not intended for emergency use.
IN CASE OF EMERGENCY, CALL 911 OR YOUR LOCAL EMERGENCY NUMBER.
Messages provided through this Service are for general informational purposes only and do not constitute medical advice, diagnosis, or treatment.
No clinician-patient relationship is created through use of this Service.

8. Intellectual Property
All content delivered through the Service is owned by Cpapcore or its licensors and is protected by applicable intellectual property laws.
You may use messages only for personal informational purposes and may not reproduce or distribute them without authorization.
9. Security and Availability
The Service is provided on an “as is” and “as available” basis.
Cpapcore does not guarantee uninterrupted or error-free operation of the Service.
10. Limitation of Liability
To the fullest extent permitted by law, Cpapcore shall not be liable for indirect, incidental, or consequential damages arising from use of the Service.
Total liability shall not exceed the amount paid for the Service in the 12 months prior to the claim or USD $3,000, whichever is lower.
11. Indemnification
You agree to indemnify and hold harmless Cpapcore from claims arising from your use of the Service, including failure to obtain required consents.
12. Governing Law
These SMS Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
13. Dispute Resolution
Any disputes shall first be resolved through good faith negotiation.
If unresolved, disputes shall be subject to binding arbitration in accordance with applicable arbitration rules, to the fullest extent permitted by law.
14. Changes to SMS Terms
We may update these SMS Terms from time to time.
Continued use of the Service constitutes acceptance of any updated terms.
